Termination of Employment Without Giving Notice
1. There is no longer a statutory retirement age. The College will, however, contact staff who are approaching age 65, to ask them when they intend to retire, for planning purposes.
2. Employees who choose to remain employed by the College beyond age 65 must demonstrate that they are still capable of carrying out their normal duties, to the satisfaction of their Head of Department. Any member of staff who, in the opinion of their Head of Department, appears no longer to be capable of carrying out their duties will be subject to a capability review, as laid down in Section 12 of this handbook.
3. Employees may retire before the age of 65 if they so wish. The date of retirement may affect entitlement to pension. Any questions regarding pensions should first be addressed either to the College Accountant, or to the Bursar.
4. Where the College wishes to terminate employment, staff shall be entitled to notice, except in cases of summary dismissal, as follows:
a. Those who have been employed for less than two years - two weeks' notice.
b. Those who have been employed for a period exceeding two years, but not exceeding thirteen years - one week's notice for every complete year worked.
c. Over thirteen years' continuous service - thirteen weeks' notice.
5. Where a member of staff wishes to terminate employment, at least one month's notice, in the case of monthly paid staff , or one week's notice, in the case of weekly paid staff, must be given in writing to the Head of Department.
TERMINATING EMPLOYMENT WITHOUT GIVING NOTICE
6. If you terminate your employment without giving, or working, the required period of notice, as indicated in your contract, you will have an amount, equal to any additional cost of covering your duties during the notice period not worked, deducted from any termination pay due to you. This is an express written term of your contract of employment.
7. On the termination of your employment you must return all College property, including tools, keys, car park pass, mobile phone, clothing, and any other property that may be in your possession or under your control. You shall not, without the written consent of the Bursar, retain any such items. If so requested by your Head of Department, you will be required to sign a statement that you have complied with this requirement. Failure to return such items will result in the cost of the items being deducted from any monies outstanding to you. This is an express written term of your contract of employment.
